|}

Sentencing
You must have all the evidence necessary to sentence someone to the appropriate charges, and you must give time served if the individual or individuals have been detained for far too long. The Warden shall be the person who issues the sentencing; however, if they are not present, the arresting officer shall issue the sentence fit for the crime. If the Individual or Individuals are faced with felony or capital sentencing without a trial progressing for 25 minutes, they are to be set free with a status of charges pending. Please see Pre-Criminal Trial for more specific information on charges pending and reoffenders.

Court Orders
The individuals specified in the three sections below can issue Court Orders, which are legally-enforced documents that carry the penalty of an Obstruction of Justice charge and forced compliance with the order by security. Each order has its own requirements and authorized issuers, but are all implied to require the stamp of the issuer to be valid.

Warrants
Warrants represent official orders to the security department, issued by the Justice Department, or in their absence, relevant officers. Warrants may order the search or arrest of an individual, or the search of an entire department. These warrants should include a name, the actions prescribed (detainment, search, arrest, etc.), and a description if applicable.

* Search Warrants; may with reasonable suspicion order the search of an individual or entire departmental area, by force if necessary. This may also include surgical procedures, cursory implant inspections, or any other invasive searches with both probable cause and evidence.
** Search Warrants should include the scope of the warrant (individual, entire department, etc), and a brief description of the reasonable suspicion, probable cause, or evidence to support the warrant.
** Warrants are required for any search on green alert, even if the individual consented. With one exception, detailed in the Individual Searches section.
** A full search of the personal belongings of an individual may be conducted on those that are under arrest, without the need for a warrant.
* Arrest Warrants; may with probable cause or evidence order the arrest of an individual who is believed to have committed a crime.
** An arrest warrant is not mandatory for conducting the arrest of an individual when the officer already has probable cause or evidence of a crime. However it may encourage cooperation when seeking to arrest someone.

Warrant Approval
Warrants must be approved by a Magistrate, Chief Justice, or Clerk. If there is no applicable Justice Department (no Magistrate, Chief Justice, or Clerk), Warrants must be approved by either the Commanding Officer or the Head of Security. If neither are an option, then it must be approved by the Warden. The individual approving the warrant cannot be the same as the individual requesting the warrant, and the individual requesting the warrant cannot go to someone else if it was denied already.

Individual Search
For a stringent search of a persons' effects (wherein stringent implies a full, complete search of all physical clothing, bags, and other storage), the warrant must include the Reasonable Suspicion for the search. Present the warrant to the suspect.

An individual may consent to a search of their belongings, waiving the need for a warrant. A written piece of paper signed by the individual in question saying they consent to a search of their belongings is required. This paper must also include the reasonable suspicion to initiate a search, and the officer's signature. After the conclusion of the search and possible arrest of the individual, the officer must deliver the consent paper to the Magistrate, Chief Justice, or Clerk if available, or to the Head of Security, Warden, or Commanding Officer if Justice Department members are unavailable.

Implant Search
For any situation requiring an implant search, you must have a warrant, and the warrant must also be approved by the CMO or in their absence the Commanding Officer. This is true even if the person is arrested with indisputable evidence, such as the Implanter with the suspect's DNA; other pieces of evidence are admissible, articulating that being unable to find the object on the person and line of sight was not lost on the suspect.<blockquote>The Captain is presented with an implant search warrant. They observe that it is lacking some details in relation to the articulation of the probable cause, lacking evidence or proper thinking on Security's part, therefore denying the warrant, expressing to security to write it better.</blockquote>Then bring in trained medical personnel under supervision of the Head of Security or Chief Medical Officer; or, the Chief Medical Officer will perform the implant search themselves after being shown the warrant— present the warrant to the suspect.<blockquote>Medical Doctor Fluffs Stargazer is observed by the Head of Security Teeg Dougland to use the Implanter device on suspect Slab Bulkhead, they soon discover that a device is pulled into the implanter, thereby completing the implant search.</blockquote>Additionally, an individual may consent to the implant search, thereby waiving the necessity for a warrant, unless it is Green Alert. A written piece of paper signed by the individual in question saying they consent to an implant search is still required.<blockquote>During a detainment on blue alert, an individual waived their rights because they'd rather get the situation over with and would rather exonerate themselves as soon as possible, saying that they give consent and provide a signature on a one-sentence piece of paper. Upon the medical personnel's efforts to use the Implanter device on the suspect, they soon find that nothing got pulled into the device's chamber, clearing the suspect's name.</blockquote>Trained medical personnel is defined in the Medical Operating Procedures.

NanoChat Search
For a search of the person's NanoChat, you must have reasonable suspicion of a crime having been committed using NanoChat or someone having an accomplice.<blockquote>For example; a detective gains knowledge of syndicates working together via a stolen syndicate encryption key and uses this knowledge to prepare a NanoChat search in advance.</blockquote>

Wiretaps & Recording
Recorders in the possession of security have a variety of uses, however, proper permission must be received in order to use them. Usage of a recorder without permission can be considered abuse of power.<blockquote>Note that recording any conversation without prior OOC permission can and will be considered a consent breach.</blockquote>Security may use recorders for recording interrogations (with the individual involved made aware beforehand). Security may also use recorders to record situations which may provide evidence for litigation, with a warrant written and approved beforehand (see warrants).<br>
For a security officer to record a situation with the expectation that suspect(s) may provide verbal evidence in the commission of a crime. You must have Reasonable Suspicion that a crime may soon occur, in order to receive a warrant, and the recording must prioritize the subject of the warrant.<blockquote>For example; a detective gains knowledge of a crime that may soon occur, and is capable of recording the discussion surrounding the crime. They receive a wiretap warrant and record a suspect in the process of committing or discussing a criminal act.</blockquote>

Departmental Search
For any situation that requires a departmental search, provide reasonable suspicion for the warrant.<blockquote>For example, two individuals broke into the Head of Personnel's room and stole some personal effects and ID cards. Probable Cause: John Security and Jane Warden witnessed two individuals run into Engineering, detaining them followed by a search, nothing was found on them in relation to the stolen goods; the stolen items were not on them and it is reasonable to believe they have stowed the items in the department.</blockquote>Present the warrant to the Departmental Head whose department is getting searched, or any applicable departmental staff.

Injunctions
The Magistrate, Chief Justice, Commanding Officer, or legally-selected judge are fully authorized to issue injunctions: legally-binding, written orders restricting Inhabitants from doing something disruptive to station productivity or personal rights. These may be issued on discretion or as relief for Civil Trials. Injunctions may not compel someone to violate Space Law or SOP, and the issuer is liable for abuse of power charges if this is misused.

An injunction must include a list of affected names and a detailed description of the restrictions to be valid.

Subpoenas
The Magistrate or Chief Justice may issue Subpoenas, which are trial-related Court Orders compelling an individual to produce evidence or make themselves present at a location for court.

A subpoena must include a list of names, a detailed description of evidence requested or reason for appearing, and a reasonable time frame no shorter than 3 minutes. The individuals summoned by the subpoena must be informed of its presence for it to be a valid order. This can be done via general announcement, fax, verbal announcement, or otherwise.

A subpoena can order an individual to:

* Appear as a witness in court;
* Produce evidence for court;
* Appear for a trial in which they are the defendant, plaintiff, or the prosecution;
* Appear for questioning in deposition.

Pressing Charges
Criminal Charges
Any crew member may press charges against any other crew member.

An individual may be charged of a crime if and only if it can be argued beyond a reasonable doubt that the accused had committed an act in the nature and fashion as described by a particular criminal charge.

An individual may not be charged of a crime if the target of the crime explicitly declines to charge them, thus making their charges toward that specific victim void and pardoned in their entirety. This does not apply to crimes that effect the station at large, such as Terrorism, theft in general, and sabotage.

Multiple counts of one crime can be charged.

For illegal actions against the station abroad, each incident separated by a reasonable period of inaction, lawful conduct, or another crime is interpreted as one count.

For crimes directly bereaving a person (violent acts, theft of personal property etc.), the same applies in addition to each victim being one count.

In the case of possession, theft, or any incident involving several separate and distinct items, only one charge may be applied.

Charges that are a direct escalation of one another in nature cannot be simultaneously held against the perpetrator if they pertain to the same incident and the same victim/item (if applicable). Only the most severe of these charges apply.

Pre-Criminal Trial
Every criminal defendant has the right to a speedy trial;

* Protects defendants from delay between the presentation of an indictment and the start of trial.

A criminal trial should take place within twenty-five minutes following the pressing of the accused charges. The accused shall be held in the brig until trial with unlimited access to their attorney if they so choose to take one.

If for whatever reason, a trial must be delayed past 25 minutes after the pressing of charges (due to unforeseen circumstances), the Commanding Officer or Head of Station Security may enact one of the below emergency actions.

* Pardon the defendant on the grounds of the station’s inability to grant the right to a speedy trial.
* Set the defendant free with a status of charges pending. Releasing an Individual does not mean they are free of charges, but rather that they have served up to capital without a trial. If the defendant is charged with a capital crime, they must be taken into custody for the duration of the trial.
If a defendant reoffends while out on charges pending, or gains a breach of custody charge while awaiting trial, security may place the defendant in Permanent Confinement. The criminal defendant retains the right to a speedy trial as soon as it can be arranged, however temporary release with charges pending may not be granted.

Civil Charges
Any crew member can sue any other crew member for inflicting them with damages caused by a breach of duty. To sue is to request compensation for said damages. To do so, the victim must prove:

* Damages: That the victim was inflicted with an emotional, physical, or monetary damage
* Breach of duty: That the defendant had a duty which they failed to uphold(e.g., a duty to not endanger crew, a duty to act respectfully), leading to the victim being inflicted with a damage
* Severity: That the damage was severe enough to warrant the compensation requested

Compensation can either be explicitly specified by the victim or left for the court to decide. Either way, the court is free to modify the compensation as it sees fit. Most often, compensation is rendered in the form of court orders compelling a crew member to do something (e.g., return an item, make an apology, or permanently avoid a certain area). Court orders should be written and stamped with the notary stamp.

Trial Procedure
A trial may only be requested for civil disputes and capital charges. While trials for disputes may be refused depending on the availability and discretion of the potential judge, capital crimes necessitate a mandatory trial.

While legal and spiritual counsel is not required, if it is available then it must be provided upon request.

A trial can be waived if the suspect pleads guilty to a member of the Justice department, or in their absence, Command Staff, while in custody, who will then be responsible for deciding the sentence for the crime.

Additionally, in situations where Standard Operating Procedure allows for capital punishments to be used in response to charges at or below the felony level, a trial is also mandatory.

The trial takes the format of an arbitration court hearing, presided over by the Magistrate or Chief Justice, or in their absence, the Court Clerk. If no impartial members of the Justice department are available, a member of command must preside over the legal proceedings.

To begin a criminal or civil trial, all charges, arguments, and evidence must be filed with the court clerk beforehand to be presented to the judge. After the clerk has submitted the compiled court case to the judge, the trial shall begin when the defense, prosecution, judge, and bailiff appointed by the judge are present.

Such procedures do not apply to miscellaneous hearings such as paroles and pardons or felony appeals, which only require the involvement of the judge and the defendant.

The judge of the trial is in-charge of ensuring the trial is completed in a timely manner, but has the ability to call recesses (breaks). The judge may grant two-minute extensions on top of the allotted time. The judge also has the power to charge someone with contempt of court, a felony, if they disrupt the case. In the event that the defendant is held in contempt of court, the necessity of a trial may be waived and sentence passed by the judge or arbiter without a full hearing.

Criminal Trials
A criminal case should aim to be 40 minutes in total, and should take no longer than an hour. Criminal cases should either have security personnel present, or plan to have them present by the end of the trial. The judge must set the court timer as per the allotted times.

# The judge brings the court in session with the gavel.
# Prosecution opens the proceedings, stating the charges and introducing witnesses and exhibits that will be brought forward during the presentation of evidence. They may also recommend a sentence to the judge, appropriate to the charge based on their opening statement. (Four minutes)
# Defense then pleads guilty or not-guilty.
## If defense pleads guilty, proceed to step 7.
## If the defense pleads not-guilty, proceed to step 4.
# Defense then provides their opening statement, contradicting the prosecution's theories and assertions. They will also introduce their witnesses and exhibits where applicable. (Four minutes)
# The presentation of evidence then follows, led by the prosecution then the defense. Cross-examination may be requested following submission of individual testimonies and granted at the discretion of the judge. (Five minutes each)
# Finally, closing statements are to be made by the prosecution, the defense, and the prosecution once more due to the burden of proof. The evidence should be reiterated by both sides and arguments refuted with no new evidence presented. (Five minutes each)
# A ruling will be made by the judge, written and stamped by the notary stamp.
## If the Defense has pleaded guilty, determine length and conditions of the sentence.
# The judge adjourns the court with the gavel.

Any present or soon-to-be-present Security personnel will then enact the ruling.

Civil Trials
Civil cases do not require attorneys or prosecutors, but they may receive assistance from either both before and during the case.

Both the defendant and plaintiff must be made to summon at the court, if a party does not appear out of either refusal or negligence, or fails to comply with a court order from a civil trial, that party may be charged with contempt of court, a felony.

A civil case involves seeking damages from a defendant, which could be monetary, an item, or otherwise. A civil case should aim to be 30 minutes in total, and should take no longer than 45 minutes. The judge must set the court timer as per the allotted times.

# The judge brings the court in session with the gavel.
# Plaintiff opens the proceedings, stating the counts, damages, and introducing witnesses and exhibits that will be brought forward during the presentation of evidence. They may also recommend civil relief to the judge, appropriate to the damages based on their opening statement. (Four minutes)
# Defense follows with their opening statement, contradicting the plaintiff's theories and assertions. They will also introduce their witnesses and exhibits where applicable. (Four minutes)
# The presentation of evidence then follows, led by the plaintiff then the defense. Cross-examination may be requested following submission of individual testimonies and granted at the discretion of the judge. (Five minutes each)
# Finally, closing statements are to be made by the plaintiff, the defense, and the plaintiff once more due to the burden of proof. The evidence should be reiterated by both sides and arguments refuted with no new evidence presented. (Four minutes each)
# A ruling will be made by the judge, written and stamped by the notary stamp.
# The judge adjourns the court with the gavel.

Presentation of Evidence
Eyewitness Testimony
Any sentient being willing and capable of presenting themselves before court under oath and present at the scene of the crime as a bystander or a victim at the time of its commission, may offer eyewitness testimony before the court at request of defense or prosecution. Extra time may be granted to either side at the behest of the arbitrator or judge to allow for witnesses not currently present.

Objection to Testimony
Any witness that falls under the following conditions may be excused as a witness or have their testimony deemed inadmissible:

* The witness lacks the mental, intellectual, or other capacity to understand the context of the case.
* The witness's inclusion will cause substantial cost or delay to the case, proceedings, or upkeep of the station.
* The witness is the judge.

General Objections
Both parties in a trial may object to testimony to have the testimony deemed inadmissible, move past the question, or rephrase a question to keep a trial within time limit:

* Hearsay: The witness testifies using an out-of-court statement by an individual not present in court, thereby rendering it impossible to verify. This testimony will be inadmissible.
* Asked and answered: A question is posed that has already been answered previously by a witness. Such a question must be skipped.
* Narrative: A question is posed that would require a significantly long answer with multiple facts, or when the witness chooses to answer a question in this way. The question must be reworded, or the witness must be reminded to answer promptly and stay on topic.

Objections are completely at the discretion of the judge, who does not always need to sustain an objection even if it is within these guidelines. It is up to the judge to decide if an objection is proper or necessary to keep the trial quick and fair.

Procedural Defense
Whereas a defendant is placed on trial, they are granted the privilege to challenge the legitimacy of charges or claims brought against them by the legal process. Any of the following may be invoked:

* Issue Preclusion/Double Jeopardy Clause: accused persons may not be tried on the same charges following an acquittal or conviction, except in the case of acquittal and subsequent credible admission of guilt.
* Entrapment Clause: accused persons found to be induced or coerced by law enforcement into the commission of the crimes listed in the charges may be acquitted or have their sentence reduced.
* Exclusionary Clause: evidence collected and/or analyzed in violation of accused persons’ rights under law may be inadmissible in court.

Research & Distribution of Experimental Technology
Epistemics has the right to refuse or allow the distribution of experimental technology under the permission of the respective Department Head. For example, the Chief Engineer gives the word or provides a written statement requesting Epistemics distribute experimental ENGINEERING tools to the Engineering crew, or the Mystagogue approves of all Epistemics using and distributing speed boots to their department. This does not mean that a Departmental Head is strictly beholden to this baseline standard; understand that as Command, they should have an acute understanding of the consequences of distributing experimental equipment.

RwWolf: /* Medbay Priority */ reworded a sentence for more clarity

Standard of Care
A reasonable level of provided medical care where the medical personnel assumes a duty of care where they are expected to treat an individual to the best of their abilities.<blockquote>For example, a medical intern may not have the resources to provide optimal medical care, when there is a lack of resources, such as advanced medical treatment and or technology.</blockquote>While errors are permissible, egregious errors resulting in grievous injuries or death can incur endangerment charges and civil liability. If a patient does not wish to be tended to, you are free of liability.

Medbay Priority
The Chief Medical Officer is the lead medical expert and has the final say in medical situations.

The chemistry lab is to be primarily operated by chemists, followed by the senior physician. Special circumstances allow other medical personnel to operate the lab, such as (but not limited to) a lack of chemistry personnel or increased access as the result of skeleton crew procedures.

Treatment of patients is primarily the responsibility of medical doctors, who are expected to handle all medical care including life saving surgeries.

Rescue operations should be carried out by paramedics, prioritizing safety and stabilization of patients.

The corpsman takes priority over doctors and paramedics when it comes to treating or rescuing security personnel, unless the number of casualties exceeds what a single corpsman can effectively manage or the corpsman requests assistance.

Medical interns may be assigned a doctor as their mentor to teach them the basics and proper application of medicine. Interns may observe or assist in surgeries but cannot act as the primary surgeon unless no other doctors are available during an emergency.

Medical Evaluation
The Chief Medical Officer of any station or vessel may declare any on-duty personnel unfit for duty and order them to be demoted; well within the grounds of medical reasoning and documentation; this includes the Commanding Officer, who cannot overrule this procedure.<blockquote>Case Law: Nanotrasen Station NTDV 0592 versus Captain Starry McFluffs The Commanding Officer at the time was investigated and deemed to be found— extremely intoxicated and unable to comprehensibly communicate with their staff and subordinates, resulting in the lack of faith and ability to command, and or negligence on the station's safety, where the Supermatter began the Delamination Event due to their inebriated state— the Head of Personnel had to step in as the Elected Commanding Officer, to prevent station wide destruction and panic, thereby enacting the Chief Medical Officer and Elected Commanding Officer to deem the original Commanding Officer unfit for duty.</blockquote>The Chief Medical Officer and relevant Departmental Head must both agree that the specified crewmate is unfit for duty for the demotion to take effect.

Right to Refuse Service
Any and all medical staff, at anytime, can refuse to treat medical care to patients for any of the following conditions or reasonings:<blockquote>A. Disruptive or Abusive patient— threatening, verbally abusing, or endangering staff and patients alike.

B. or, Violation of the Hippocratic Oath— going against the ethics of the medical personnel

C. or, Medical resources constraint

D. or, genuine lack of expertise in treatment methods</blockquote>

Quarantine
Medical personnel are afforded the right to quarantine any individual or individuals that suffer from an infectious or contagious diseases; allowing them to confine them within predesignated quarantine zones then providing a course for treatment until they are no longer a vector of infection or contagion that's harmful to the crew.

Do Not Resuscitate / DNR
A Do Not Resuscitate or DNR order is a legal document that instructs medical personnel not to perform lifesaving treatment or cloning to the individual listed on the order.<blockquote>A. The individual is a drain on medical resources, implicating them that they do not value their own life

B. or, an elective by the individual themselves to not be resuscitated

C. or, a lawful injunction or court order, i.e.: stasis for malicious, difficult-to-contain individuals</blockquote>

Surgical Procedures
Only trained, capable medical personnel should be able to do invasive procedures or surgeries, this includes, but not limited to removal of implants or inspection. Standard of Care applies to this procedure. Any personnel who are not active medical staff, or, in emergency situations, the corpsman/Captain/ACO, are not to commit surgery on another individual, as it is considered a felony.

The chemistry lab is to be primarily operated by chemists followed by the senior physician. Special circumstances can allow other personnel to operate the lab such as but not limited to; no chemist is available or their status is unknown or skeleton crew access.

When confining someone inside of the brig, the suspect should be handed to the Warden for processing. It is then the responsibility of the Warden to search, confine, and process the suspect in alignment with sentencing procedures. See pre-criminal trial procedures if brig time exceeds 25 minutes. If the Warden is not available, then it is the responsibility of the arresting officer to process the suspect and handle evidence.

Treatment of Prisoners
Prisoners have certain rights that <u>must</u> be upheld by security and command personnel. Non-permanent confinement prisoners should be searched before they are uncuffed. Non-perma prisoners must be provided with the following:

* Adequate medical care and moral, spiritual, or legal counseling if it is requested and available.
** These are rights, not privileges.
* Their original headset with only authorized encryption keys.
** This right may be revoked should it be abused.
* Clothing, food, and water on request.
* Habitable holding cells or permabrig.
** If the secureness and safety of the holding area become compromised, the prisoners must be relocated, until the holding cells or permabrig are returned to a serviceable state.
* Freedom of movement within their holding area.
** Unless there is an undue risk to life and limb.
* Their original belongings, unless the item in question is contraband, being used as evidence in a crime, or they are an extended confinement prisoner.

Extended Confinement Prisoners
Additionally, prisoners in Extended Confinement have certain rights but also more firm restrictions that <u>must</u> be upheld by law enforcement:

* Only Extended Confinement prisoners may receive visitors.
** A maximum of one individual may be permitted to visit a single convict every 10 minutes; a reason must be provided for the visit, and the visitor must consent to a search of their belongings.
** The Warden or Head of Station Security may void the visiting time limit at their discretion.
* Upon approval, prisoners may request supervised work release if the staffing is available.
* Prisoners who intentionally and maliciously cause structural damage to the permabrig, to a degree that makes it unreasonable to hold prisoners within, are thereby guilty of a capital crime and may receive trial.
* Prisoners who intentionally, maliciously, and repeatedly cause significant bodily harm to their fellow inmates, visitors, and/or security staff are thereby guilty of a capital crime and may receive trial.
* Prisoners may request retrial for capital crimes; these requests may be refused depending on the discretion and availability of the court clerk, chief justice, or at the discretion of the warden or head of station security.
* Prisoners may request or may otherwise be given parole as permitted by the Paroles and Pardons section.

Preservative Stasis
Should prisoners repeatedly and maliciously antagonize law enforcement, to an extent where continued extended confinement or Solitary Confinement becomes infeasible, two of the three authorized personnel; the Warden, Head of Security, or Commanding Officer, may agree to temporarily upgrade the relevant prisoners’ sentences to Preservative Stasis summarily.

There are two methods of preservative stasis:

# Stasis bed, in which you put a person in either a critical or dead state on a stasis bed.
# Morgue, in which you put a person in a dead state in the morgue.

In both of these cases, you are to commit as ethical and humane of an execution to enact preservative stasis as possible. If you have the luxury, you should prioritize doing the execution through medical staff instead of using lethal force to prevent unnecessary damage physically, mentally, or otherwise. The preferred method of execution is putting them under as you would for surgery, making them fall asleep, and then injecting them with the necessary poison to either kill or put them in a critical state.

Solitary Confinement
Should an extended confinement prisoner repeatedly and maliciously antagonize law enforcement, the Warden, Head of Security, or Commanding Officer may temporarily place the aforementioned prisoner in Solitary Confinement for a maximum of twenty minutes.

Prisoners in Solitary Confinement must have their rights as a prisoner upheld, excluding visitations. Prisoners in Solitary Confinement are only permitted to be visited for medical purposes while within confinement. Prisoners are to be bolted into a small cell, and said cell should only be unbolted during the period of confinement to handle requests within the bounds of their rights.

Paroles and Pardons
Prisoners may be admitted for parole by the Warden or Head of Security, or may apply for parole at the discretion and availability of the aforementioned parties under the following conditions:

* Shows peaceful compliance and assists officers with their duties.
* Displays clear signs of remorse concerning the committed crime and/or criminal behaviors

If parole is requested, they may receive a parole hearing conducted by the Magistrate, Court Clerk, or Chief Justice, where they will state their case on why they should be released; they may request legal counsel in this hearing, but must represent themselves.

The sentencing officer of an arrest, the judge or arbiter of a trial, or the Warden - for extended confinement prisoners, may pardon members accused or sentenced for crimes if deemed in the best interest of the crew and vessel, and when the circumstances of the defendant or offense warrant suspension of sentence.

You must have all the evidence necessary to sentence someone to the appropriate charges, and you must give time served if the individual or individuals have been sitting in the Brig for far too long.

Recorders
Recorders in the possession of security have a variety of uses, however, proper permission must be received in order to use them. Usage of a recorder without permission can be considered abuse of power.<blockquote>Note that recording any conversation without prior OOC permission can and will be considered a consent breach.</blockquote>Security may use recorders for recording interrogations (with the individual involved made aware beforehand). Security may also use recorders to record situations which may provide evidence for litigation, with a warrant written and approved beforehand (see warrants).

Warrants
Warrant Approval
Warrants must be approved by a Magistrate, Chief Justice, or Clerk. If there is no applicable Justice Department (no Magistrate, Chief Justice, or Clerk), Warrants must be approved by either the Commanding Officer or the Head of Security. If neither are an option, then it must be approved by the Warden.

For an implant search, you are also required to have the Chief Medical Officer sign off alongside the other approval. The approver of the warrant cannot be the same as the writer of the warrant, and the warrant writer cannot go to someone else if it was denied already.

Implants
For any situation requiring an implant search, you must have a warrant, even if the person is arrested with indisputable evidence, with evidence such as the Implanter with the suspect's DNA; other pieces of evidence are admissible, articulating that being unable to find the object on the person and line of sight was not lost on the suspect.<blockquote>The Captain is presented with an implant search warrant. They observe that it is lacking some details in relation to the articulation of the probable cause, lacking evidence or proper thinking on Security's part, therefore denying the warrant, expressing to security to write it better.</blockquote>Then bring in trained medical personnel under supervision of the Head of Security or Chief Medical Officer; or, the Chief Medical Officer will perform the implant search themselves after being shown the warrant— present the warrant to the suspect.<blockquote>Medical Doctor Fluffs Stargazer is observed by the Head of Security Teeg Dougland to use the Implanter device on suspect Slab Bulkhead, they soon discover that a device is pulled into the implanter, thereby completing the implant search.</blockquote>Additionally, an individual may consent to the implant search, thereby waiving the necessity for a warrant unless it is Green Alert, but a written piece of paper signed by the individual in question saying they consent to an implant search is still required.<blockquote>A individual waived their rights because they'd rather get the situation over with and would rather exonerate themselves as soon as possible, saying that they give consent and provide a signature on a one-sentence piece of paper. Upon the medical personnel's efforts to use the Implanter device on the suspect, they soon find that nothing got pulled into the device's chamber, clearing the suspect's name.</blockquote>Trained medical personnel is defined in the Medical Operating Procedures. For any searches on green, you require a search warrant even if the individual consented if the individual is not under arrest.

Departments
For any situation that requires a departmental search, provide Probable Cause for the warrant.<blockquote>For example, two individuals broke into the Head of Personnel's room and stole some personal effects and ID cards.

Individuals
For a stringent search of a persons' effects (wherein stringent implies a full, complete search of all physical clothing, bags, and other storage), the warrant must include the Reasonable Suspicion for the search. Present the warrant to the suspect.

Wiretaps
For a security officer to record a situation with the expectation that suspect(s) may provide verbal evidence in the commission of a crime. You must have Reasonable Suspicion that a crime may soon occur in order to receive a warrant, and the recording must prioritize the subject of the warrant.<blockquote>For example; a detective gains knowledge of a crime that may soon occur, and is capable of recording the discussion surrounding the crime. They receive a wiretap warrant and record a suspect in the process of committing or discussing a criminal act.</blockquote>

In the case of possession, theft, or any incident involving several separate and distinct items, one charge may be applied per relevant item.

Charges that are a direct escalation of one another in nature cannot be simultaneously held against the perpetrator if they pertain to the same incident and the same victim/item (if applicable). Only the most severe of these charges apply.

Pre-Criminal Trial
Every criminal defendant has the right to a speedy trial;

If a defendant reoffends while out on charges pending, security may place the defendant in Permanent Confinement. The criminal defendant retains the right to a speedy trial as soon as it can be arranged, however charges pending may not be granted.

Warrants
Warrants represent official orders to the security department, issued by relevant officers or the Justice Department. Warrants are only valid when issued by either the Magistrate, or in their absence, the Commanding Officer, Head of Security, or Warden.

* Individual Warrants; may order the search or detainment of an individual, or the arrest of the individual with evidence. This may also include surgical procedures, cursory implant inspections, or any other invasive searches with both probable cause and evidence.
** These warrants should include a name, the actions prescribed (detainment, search, arrest, etc.), and a description if applicable.
* Search Warrants; may order the search of an entire departmental area, by force if necessary, and may order the arrest of listed individuals implicated in a crime or crimes with probable cause or evidence.
** Search Warrants should include an area, a brief description of the probable cause, and a list of individuals if applicable.

Injunctions
The Magistrate, Commanding Officer, or legally-selected judge are fully authorized to issue injunctions: legally-binding, written orders restricting Inhabitants from doing something disruptive to station productivity or personal rights. These may be issued on discretion or as relief for Civil Trials. Injunctions may not compel someone to violate Space Law or SOP, and the issuer is liable for abuse of power charges if this is misused.

An injunction must include a list of affected names and a detailed description of the restrictions to be valid.

Subpoenas
The Magistrate may issue Subpoenas, which are trial-related Court Orders compelling an individual to produce evidence or make themselves present at a location for court.

* Appear as a witness in court;
* Produce evidence for court;
* Appear for a trial in which they are the defendant, plaintiff, or the prosecution;
* Appear for questioning in deposition.

The trial takes the format of an arbitration court hearing, presided over by the Magistrate. If no impartial members of the Justice department are available, the Magistrate or a member of command must preside over the legal proceedings.

<blockquote>Security SOP covers handling yourself as a security officer. For all Security-related legal matters (such as brigging, warrants, and trials), see Judicial Procedures.</blockquote>

Force Escalation / Use of Force
This simple, short chart dictates how to proceed with a general arrest. However, depending on what the individual encounters at the station, you can escalate it as needed. You utilize Force Escalation and Rules of Engagement hand-in-hand.

Verbal Commands -> Non-Lethal Methods of Apprehension -> Lethal Methods of Apprehension

It would be best if you prioritized initiating by declaring an order, i.e.: "Stop!" "Stop, or I will shoot you!" "Hey! Stop moving!" Any of these methods will allow you to upgrade your Force Escalation higher on the scale as you move up non-lethal methods (baton, disabler, rubber-tipped munitions). However, not all situations are perfect; sometimes you have to act before you speak.

Use of Force Additions
To be used when you have exhausted your baton's charges or disabler shots. This does not mean you should take out your knife or utilize a powered-down baton to apprehend someone. You can use your Flash, or Flashbang grenades. You may upgrade to using your MK58 with Rubber-Tipped Munitions when the situation is still not contained. Additional apprehension or dispersal tools can be used, such as Stingers, Truncheons, and Tear Gas.

Rules of Engagement
Security personnel hold unrestricted armaments licenses under Tier 2. They, alongside the Captain or the Blueshield Officer, are authorized at all times to use lethal force to the extent necessary to neutralize adversaries under any of the following circumstances:<blockquote>If the adversary exhibits a clear and present danger to the vessel by physical means.

If the adversary poses a significant threat of severe bodily injury or death to the officer or others.

If the adversary presents an existential threat to the chain of command by illegal means.

If the adversary cannot be reasonably subdued through non-lethal means without great bodily harm to the officer; wherein an “adversary” is an entity that demonstrates a hostile intent, commits or directly contributes to a hostile act that does not constitute an actual attack, or is actively attacking the vessel or its crew.</blockquote>

Search & Seizure
You must search and seize any object that is believed to be used in the commission of the crime. However, one should not seize non-NT-aligned objects, such as non-standard branded clothing and paraphernalia, that pose little risk. It should be removed from the person, placed in an evidence locker, and returned to them. Any contraband, as defined under the Contraband List, shall be seized from the individual.<blockquote>You may not confiscate PDAs or IDs without evidence beyond a shadow of a doubt that a crime was committed using their PDA. In general, if you confiscate it, have evidence beyond a shadow of a doubt, including for thieving gloves.</blockquote>

Armory Procedure
When on station, the Warden is ultimately responsible for stocking the armoury and distributing and recording the collection of weapons. However, if they are absent, it falls on the Head of Security.

The distribution of weapons and munitions must follow Force Escalation, Rules of Engagement, and Alert Procedure. Once the threat is dealt with, the Warden or Head of Security shall issue a recall for all weapons to be returned, and a restock should be in order. Non-Crew shall not be issued weapons from the armoury.

Conditional Situations
This does not mean that as Head of Security or the Warden, you can wander around the halls fully armed to the teeth for all circumstances.

For example, the Warden and Head of Security may carry one (1) longarm such as a Laser Rifle or Lecter or Drozd, or Antique weaponry, then wear their assigned Hard Suit, and common apprehension tools.

However, security officers and cadets should only be assigned similar kits when applicable to the alert level.

Reasonable Suspicion
A security officer may detain someone for a short period of time if they reasonably believe the person is committing, involved in committing, or conspiring to commit a crime. They may only search the individual with an approved search warrant (even if they consent to being searched); therefore, we recommend that officers procure such a warrant before detaining said individual. Additionally, if the detained individual is found in possession of any illegal items and is charged, the time spent detained will be deducted from the total brig time. The need for a warrant is waived during Blue Alert or more severe alert levels or if they are under arrest. Three example scenarios of Reasonable Suspicion would be, but not limited to:<blockquote>A. The security officer receives reasonable reports of someone with a lethal weapon.

B. The security officer spots someone with an otherwise unusual or suspicious item: (chief examples of this not covered above would be makeshift cuffs & unpermitted clothing, such as command uniforms)

C. The security officer observes someone acting out-of-ordinary or obscuring their identifiable features around restricted areas or scenes of crime, fleeing unusually from the crime scene, or fitting the description presented at the scene of a crime set by fellow officers or witnesses</blockquote>

Probable Cause
Probable Cause is an escalation of Reasonable Suspicion, wherein the security officer obtains sufficient and near-irrefutable evidence to support that someone is involved in or going to be involved in committing a criminal act. Often, this requires the officer's direct view. During green alert an approved arrest warrant is needed to legally enter departments to effect an arrest unless actively pursuing or entry is permitted by the head of the department or the captain. Three example scenarios of Probable Cause would be, but not limited to:<blockquote>A. The security officer undeniably spots someone quickly pull out a lethal, non-permitted weapon.

B. The security officer watches someone flee from an area with stolen items.

C. The security officer sees someone breaking open an area in which they are restricted from accessing.</blockquote>

Detainment versus Arrest
Detainment: Stop & Frisk, Free to Go
When an individual is detained, at the officer's discretion, the individual can be cuffed for officer safety. Thus, the officer can do their job in a search (frisk). You may do this at any time during blue or higher alert level, or with a approved search warrant on green alert, citing your Reasonable Suspicion on the warrant.

This means a pat-down, which involves checking their bag, pockets, and jacket/coat/overalls, but not other clothing, for anything related to Chameleon Technology or similar. If evidence of holofibers are found on the aforementioned clothing, search all personal effects for further evidence. As Security, the officer shall not maliciously repeatedly detain someone.

If nothing is concealed on the individual that would constitute Contraband, you are still detained until security lets you go. However, if Security has been called away, and they don't verbally express that you are free to go, the detainment is void and you are free to go. The officer must be physically present to enact the detainment.

Arrest: Contraband Found
If something on the individual that is considered Contraband, it will become an arrest, and said individual will be sent to the Brig for the applicable charges; additionally ensure they are searched again before being placed in the Brig.

Fleeing Individual
When Security is enacting a detainment to possibly arrest a wanted person, and the individual begins to flee, Security can utilize ranged non-lethal apprehension methods.

There must be probable cause to utilize Lethal Force if the officer can articulate that the fleeing individual will cause serious harm to the officers, station, and/or crew at large, or has continually slipped out of cuffs, or has readily escaped their Brig cell.

Specialized Roles
Certain roles can be prone to multiple SOPs at once, due to being related to multiple departments. Corpsman is an example of this. Their dedicated SOP can be found in Specialization Operating Procedures

During green alert an arrest warrant is needed to legally enter departments to effect an arrest unless actively pursuing or entry is permitted by the head of the department or the captain.
